AN ACT TO AMEND PROVISIONS OF SECTION 20 OF THE PUBLIC FINANCE ACT TO ALLOW FOR THE ESTABLISHMENT AND WINDING UP OF SUB-HEADS UNDER A SPECIAL FUND.

ENACTED BY THE PARLIAMENT OF TUVALU

Commencement [28th November, 2018]

1 Short Title

This Act may be cited as the Public Finance (Amendment) Act 2018.

2 Commencement

This Bill shall come into force on a date appointed by the Minister.

3 Amendment to section 20 (1)

Section 20 (1) is amended by inserting after the words, "Any such fund" and before the word "shall" the following words, "may consist of sub-heads and" to read:

"(1) The Minister may from time to time by order establish Special Funds which shall not form part of the Consolidated Fund. Any such fund may consist of sub-heads and shall be governed by the provisions of this section and the moneys of such a fund may only be expended for the purposes for which it was established.".

4 Amendment to section 20 (3) (b)

Section 20, sub-sections 3 (b) is amended by inserting the words "or any sub-head under a Special Fund" after the words "Special Fund" and before the word "be", to read:

"(b) by order direct that any Special Fund or any sub-head under a Special Fund be wound up;".
