AN ACT TO AMEND THE ISLAND COURTS ACT

Commencement [24 December 2020]

1 Short Title

This Act may be cited as the Island Courts (Amendment) Act 2020

3 Amendments

(1) Section 9 is amended as follows:

(a) Renumber subsection (2A) as subsection 3
(b) Renumber subsection 3 as 4
(c) Insert new subsection (5) as follows:

• "(5) Notwithstanding anything contained in this Act, the Senior Magistrate may permit an Island Court to be constituted by one or two island Magistrates."

(3) Section 10 is amended by repealing the entire section and replacing it with the following:

"(a)Subject to section 9(5), any decision, whether final or not, of an island court shall be that of the 3 island magistrates of which such court is composed, or failing agreement between them, the decision of the majority of them shall prevail.
