FALEKAUPULE (AMENDMENT) ACT 2016

Act No.09 of 2016

AN ACT TO AMEND THE FALEKAUPULE ACT TO PROVIDE FOR ADDITIONAL QUALIFICATION OF VOTERS WITHIN THE FALEKAUPULE AREA

Commencement [7th September, 2016]

1. Short Title

This Act may be cited as the Falekaupule (Amendment) Act 2016.

2. Purpose

The purpose of this Act is to amend the Falekaupule Act to provide for additional qualification of voters within the Falekaupule area.

3. Amendment to section 14 of the Falekaupule Act

Section 14 of the Falekaupule Act is repealed in its entirety and replaced with the following:

• "14 Qualification of voters
• Subject to section 15; every person who -
  • (a) has attained the age of 18; and
  • (b) is a resident in the Falekaupule area; and
  • (c) has paid rates to the Kaupule or has been exempted under section 86(2)(1) or 88; and
  • (d) is actively participating in the activities of the Falekaupule's island community, as verified by the Falekaupule,
• is entitled to be registered as a voter and, when so registered, to vote at the election of a member of the Kaupule in that area."
