FALEKAUPULE (AMENDMENT) (NO. 1) ACT 2019

AN ACT TO AMEND THE FALEKAUPULE ACT TO ENABLE THE FALEKAUPULE TO ELECT AND REMOVE ITS KAUPULE MEMBERS DIRECTLY

Commencement [23rd September, 2019]¹

1 Short Title

This Act may be cited as the Falekaupule (Amendment) (No. 1) Act 2019.

2 Purpose

The purpose of this Act is to amend the Falekaupule Act to enable the Falekaupule to directly elect and remove the Kaupule members.

3 Amendment to section 8

Section 8 is replaced with the following

Election of Kaupule members

a) Subject to this section, each Kaupule shall have 6 members elected by registered voters in the manner specified in this Part.
b) Notwithstanding anything to the contrary in this Part, a Falekaupule may by resolution decide to elect and terminate its Kaupule members directly.
