CONSTITUTION (AMENDMENT) ACT 2018
AN ACT TO AMEND THE CONSTITUTION TO REFLECT THE DISQUALIFICATION OF A PERSON FROM BEING ELECTED AS A MEMBER OF PARLIAMENT
Commencement [28th November, 2018]
1 Short Title
This Act may be cited as the Constitution (Amendment) Act 2018.
2 Commencement
This Act shall come into operation on such date as the Minister by notice appoints.
3 Purpose of the Act
To disqualify the person from being elected as a Member of Parliament if he or she has been sentenced by a court in a commonwealth country to death or to imprisonment and has not received a free pardon, or serving a prison sentence.
4 Amendment to section 95(1)(a)
Section 95(1)(a) is amended by omitting the words "for a term exceeding 12 months" to read:
"(a) Subject to section 102 (calculation of sentences) and to subsection (2), he has been sentenced by a court of commonwealth country to death or to imprisonment (by whatever named called), and has not received a free pardon, or is serving a prison sentence; or"
