1 Citation
These Regulations may be cited as the Passports Regulations.
2 Application for a Tuvalu Passport as a Tuvalu citizen or stateless person
(1) Every application for a Tuvalu Passport as a Tuvalu citizen or stateless person shall be made to a Passport Officer in Form 1A set out in Schedule 1 to these Regulations, shall be witnessed by an approved person, and shall be accompanied by the prescribed documents and by the fee prescribed in Schedule 2 to these Regulations.2
(2) In this Regulations "approved person" means a Member of Parliament, a Minister of Religion, a public officer holding a post graded level 5 or above, an Island President, a person authorised to administer oaths under the Oaths and Statutory Declarations Act, or a person of similar standing to whom the applicant is personally known.
(3) In this Regulation, "prescribed documents" means —
- (a) documentary or other sufficient evidence that the applicant is a citizen of Tuvalu, or in the case of an application under section 7(3) of the Passports Act that the applicant has the required connection with Tuvalu:
- (b) documentary or other sufficient evidence of the applicant's age and marital status:
- (c) two copies of a recent photograph of the applicant approximately 1 1/2 inches in size, showing a sufficient likeness of the applicant, and with one copy certified by the person witnessing the application:
- (d) if the applicant's spouse is to be included in the passport, a similar photograph of the applicant's spouse, certified as aforesaid; and sufficient evidence of the wife's Tuvalu citizenship;3
- (e) if any child is to be included in the passport, documentary or other sufficient evidence of the child's age and relationship to the applicant.
2A Application for a Tuvalu Passport by an Investor Immigrant4
(1) Every application for a Tuvalu Passport as an investor immigrant shall be made to the Investment Passport Committee on Form 1 set out in Schedule 1 to these Regulations, shall be witnessed by the Tuvalu Trade Commissioner in Hong Kong or a Notary Public, and shall be accompanied by the documents specified in the form.
(2) An application for a spouse or up to 2 dependant children under the age of 18 to be included in a passport issued under sub-regulation (1) or to be issued with a separate passport as an investor spouse or investor dependant child shall also be made on Form 1 and may be made either at the time of the original application or subsequently.
(3) Before issuing to any person a Tuvalu Passport as an investor immigrant, investor spouse or investor dependant child, or including any person as a spouse or child on the passport of an immigrant investor, the Investment Passport Committee shall satisfy itself as far as practicable that the person —
- (a) is in good health and of sound mind;
- (b) is of good character, that is to say —
- (i) has no conviction in a court in any country for an offence which in Tuvalu would render him liable to imprisonment for a period exceeding 6 months or to a fine exceeding $200; and
- (ii) has not served a sentence of imprisonment in any country for any offence, unless the conviction or sentence was subsequently set aside on appeal;
- (c) is acquainted with and respects the laws, customs and culture of Tuvalu;
- (d) is able and willing to make a substantial investment in Tuvalu by way of a fee for the issue of a passport;
- (e) in all other respects is suitable to be granted a passport, or included on a passport, enabling him or her to enter, reside and work in Tuvalu as an investor immigrant, investor spouse or investor dependant child, as the case may be.
(4) When the Investment Passport Committee has made a decision on an application under sub-regulation (1) or (2), it shall —
- (a) endorse Form 1 accordingly;
- (b) notify the applicant that a passport will be issued upon receipt of the prescribed fee;
- (c) upon receipt of the prescribed fee, issue a Tuvalu Passport to the investor immigrant and, if appropriate, to his or her spouse and up to 2 dependant children under the age of 18 years.
(5) An endorsement of Form 1 by the Investment Passport Committee under subregulation (4)(a) shall be sufficient evidence of the fact so endorsed.
(6) In relation to an application for a Tuvalu Passport by an investor immigrant, or by the spouse or child of an investor immigrant, references in these regulations to a Passport Officer shall be construed as references to the Investment Passport Committee but in all other respects the provisions of these regulations shall apply to such an application.
3 Rules as to wives and children
(1) The spouse of a citizen of Tuvalu who has not acquired Tuvalu citizenship shall not be included in the spouse's passport.5
(2) A natural or adopted child under the age of 18 years may be included in either the father's or the mother's passport, but such inclusion shall not of itself confer any right to Tuvalu citizenship.
(3) A Tuvalu Passport will only be issued to a person under the age of 18 years on proof that the parent or guardian of such person consents to such issue. Application for a Tuvalu Passport for a person under the age of 18 years shall be on Form 1B.
(4) The inclusion of a child on a Tuvalu Passport shall cease to be valid upon such child attaining the age of 18 years.
(5) Up to 2 investor dependant children under the age of 18 years may be included in an investor immigrant's passport, on payment of the prescribed fee.6
4 Validity and renewal of Tuvalu Passports
(1) A Tuvalu Passport shall be valid and current for 5 years from the date of issue in the first instance, unless the Minister directs a shorter period in any particular case or the passport is surrendered or cancelled.
(2) A Tuvalu Passport may be renewed from the date of its expiry for a period not exceeding 5 years upon application in accordance with regulation 9.
(3) At the end of 10 years from the date of first issue of a Tuvalu Passport, or if at any time there is no further space for endorsements or visas therein, the passport shall cease to be valid.
5 Surrender of old passports
(1) An applicant who is in possession of a United Kingdom passport or a British Colonial or Protectorate passport shall produce such passport for cancellation by a Passport Officer before a Tuvalu Passport can be issued to him.
(2) An applicant for a new Tuvalu Passport shall not be required to prove afresh any matters which are apparent on the face of any passport which he is then surrendering or replacing.
6 Place and time of issue of passports
(1) Any application for or relating to a Tuvalu Passport may be made either in person or by post to the office of a Passport Officer or authorised overseas representative, but a Passport Officer or overseas representative may require a person applying by post to attend in person to answer any question relating to such application.
(2) Applications for or relating to a Tuvalu Passport should normally be made at least 14 days before the passport is required, or as may be, but a Passport Officer may in exceptional circumstances waive this requirement.
7 Certificates of Identity
(1) A person requiring a Tuvalu Certificate of Identity, whether as an emergency measure or under the provisions of section 13(1) of the Passports Act, shall apply for the same in Form 3 set out in Schedule 1 to these Regulations, accompanied by the fee prescribed in Schedule 2 and such documentation as the Passport Officer may reasonably require.
(2) A wife or child may not be included in a Certificate of Identity.
(3) A Certificate of Identity shall be valid for 6 months in the first instance and may be renewed once for a further period of 6 months.
(4) A Certificate of Identity shall be in Form 4 set out in Schedule 1 to these Regulations.
8 Seamen's Certificates
(1) A person requiring a Seamen's Certificate of Nationality and Identity shall apply for the same in Form 5 set out in Schedule 1 to these Regulations, accompanied by the fee prescribed in Schedule 2 and such documentation as the Passport Officer may reasonably require.
(2) A Seamen's Certificate of Nationality and Identity shall be valid for 3 years in the first instance and may be renewed twice for periods of 3 years each.
(3) A Seamen's Certificate of Nationality and Identity shall be in Form 6 set out in Schedule 1 to these Regulations.
9 Procedure for renewals
An application for renewal of a Tuvalu Passport, Certificate of Identity or Seamen's Certificate of Nationality or Identity shall be made to a Passport Officer in Form 2 set out in Schedule 1 to these Regulations, accompanied by the fee prescribed in Schedule 2 and such documentation as the Passport Officer may reasonably require.
10 Endorsements
An application for endorsement of a Tuvalu Passport, in respect of countries for which it is valid or other matters, shall be made to a Passport Officer in writing and accompanied by the fee prescribed in Schedule 2 to these Regulations and such documentation as the Passport Officer may reasonably require.
11 Replacement of passport
(1) Any person whose passport or other travel document has been lost or stolen shall make every effort to recover the same and shall forthwith report such loss or theft to a police officer. A Passport Officer shall not replace a lost or stolen passport or other travel document unless satisfied that the holder thereof has taken such steps as aforesaid.
(2) Any person whose passport or other travel document is damaged or defaced shall produce the same to a Passport Officer as soon as possible for repair, endorsement or replacement as the case may be.
(3) An application for the replacement of a lost, stolen or damaged Tuvalu Passport or other Tuvalu travel document shall be made in the same manner as one for the issue of a new Tuvalu Passport or other travel document.

I declare that I am in good health, that I do not have any criminal convictions which would disqualify me as an investor immigrant in Tuvalu, that I am acquainted with the laws, customs and culture of Tuvalu, that I am able and willing to make an investment in Tuvalu by way of a fee for the issue of a passport, and that if I enter and reside in Tuvalu I will abide by its laws and seek to contribute to its development.
B. I declare that the information contained in this application and the documents attached to it are complete and correct. I understand that any false statement or concealment of a material fact in this application may result in the cancellation of my Tuvalu passport and that a fraudulent statement in this application may render me liable to prosecution under the laws of Tuvalu.
C. I hereby authorise the Government authorities, including all police and judicial authorities, in all countries in which I have resided, to release to the Government of Tuvalu all records and information which they may possess concerning any criminal proceeding against me, including the investigation, arrest, charge, trial, conviction and sentence. I understand that this information will be used to assist in evaluating my suitability to be the holder of a Tuvalu Passport and generally in connection with enquires under the Tuvalu immigration legislation.
D. I understand that, having applied for Tuvalu Passport, I may be required to undergo a medical examination. I therefore consent to details concerning my past and present medical condition, wherever they are held, being released to the immigration authorities of the Government of Tuvalu in connection with that application.
E. I confirm that I understand —
a) that the contribution of US$ 15,000 which I make to the Government of Tuvalu for the issue of a Tuvalu Passport is non-refundable;
b) that my spouse and up to 2 dependant children (unmarried and aged under 18) may separately apply for a Tuvalu Passport, that the Government of Tuvalu has the right to refuse to issue such passports, but that if it they are issued, a further US$ 15,000 is payable;
c) that the Government of Tuvalu has the right to refuse to issue or renew any passport if I or my spouse or any dependant child applying for a passport is found to have committed a serious criminal offence.

NOTE
1. This form may be completed in English or Chinese. Section 1 must be completed by every applicant for a passport as an investor immigrant. Section 2 must be completed by the spouse of an applicant who wishes to be included in the applicant's passport, or issued with a separate passport as an investor spouse.
2. Section 3 must be completed by an applicant who wishes to have a dependant child included in the passport or issued with a separate passport as an investor dependant child. No more than 2 dependant children up the age of 18 may be included in this application.
3. This application must be witnessed by the Tuvalu Trade Commissioner in Hong Kong or by a Notary Public. A list of notaries is available from the Trade Commissioner's office, the address of which is included in the attached information leaflet.
4. Six copies of a recent passport size photograph of the applicant and, if a spouse or child is include, of the spouse and child, must accompany this application. The Tuvalu Trade Commissioner or a Notary Public should endorse the back of two copies of each photograph to the effect that it is a true likeness of the applicant or of the spouse or child as the case may be.
5. The following documents should accompany this form —
(a) a copy of the applicant's birth certificate;
(b) if a spouse or child is included in the application, a copy of the birth certificate of the spouse and every child;
(c) if a spouse is included in the application, a copy of the marriage certificate;
(d) if the applicant or a spouse or child included in the application has ever changed his or her name, other than by marriage, documentary evidence that the change has been bona fide made for all purposes;
(e) a recent medical certificate showing that the applicant, and any spouse or child included on this form, is in good overall health and does not suffer from any contagious or infectious decease;
(f) a certificate from the chief officer of police for the town or district where the applicant normally resides, showing that the applicant, and any spouse or child included on this form, does not have any criminal record, or describing any criminal convictions known to the police.
(Copies of these documents endorsed by the Tuvalu Trade Commissioner in Hong Kong or by a Notary Public to the effect that he or she has seen the originals and that the copies are true copies will suffice.)
6. In order to be able to sign Declaration A on the form, an applicant (and spouse, if included) will need to study the enclosed information leaflet about Tuvalu. Further copies of the leaflet, and further information about Tuvalu, can be obtained from the Tuvalu Trade Commissioner in Hong Kong.
7. The completed application form, together with photographs and certified copies of documents, should be sent to the Tuvalu Trade Commissioner in Hong Kong. No fee is payable for the application.
8. If the application for a passport is approved, the applicant will be notified, and will then, if he or she still wishes to proceed, be required to pay the prescribed fee for the issue of the passport. The fee is US$ 15,000 for a single investor.
9. If an application for a spouse or dependant child to be included in a passport, or issued with a separate passport, is successful, the applicant will be notified and will then, if he or she wishes to proceed, be required to pay the prescribed fee for the necessary action to be taken. The fee is US$ 15,000 for a spouse and up to 2 children, either included in the investor's passport or issued with their own passports.
10. A passport when issued should be collected by the applicant in person either from the Government Offices, Funafuti, Tuvalu, or from the office of the Tuvalu Trade Commissioner in Hong Kong. When the passport is collected, the applicant may be asked additional questions about the matters covered by this form, and about his or her intentions as regards residence in Tuvalu.

GOVERNMENT OF TUVALU PASSPORTS REGULATIONS
FORM 1A
(Regulation 2(1))
APPLICATION FOR A PASSPORT AS A TUVALU CITIZEN8
IMPORTANT. Read instructions carefully before completing the form. NOTES
HOW TO COMPLETE FORM
1. Sections 1, 2, 6 and 7 of this form must be completed by all applicants for new passports. Sections 3(a) and 3(b) must also be completed by those to whom these sections apply. Sections 4 and 5 must be completed if the applicant's spouse and children under 18 are to be included in the passport. A joint passport for husband and wife cannot be issued if the spouse is not Tuvaluan. Marriage certificate must be produced.
(N.B. A joint passport cannot be used by the spouse when he or she is travelling alone.)
The form should be clearly written in the applicant's own handwriting using block capitals for all names.
A new passport is required by a woman on marriage and the fee must be paid. Where the husband and wife are included on a joint passport
the charge covers both.
Children over 18 years of age may not be included in an adult's passport. Applications for a separate passport for a child under 18
should be made on Form 1B.
2. Authentication of Application. The application must be witnessed in Section 8 by a Member of Parliament, Minister of Religion, public officer holding a post graded level 5 or above, an Island President, a person authorised to administer oaths or a person of similar standing to whom the applicant is personally known.
3. Photographs. Two copies of a recent photograph of the applicant (and also of the spouse where a joint passport is applied for) must be included with the application. These photographs must be taken full face without hat, and the photographs must not be mounted. The size of the photographs must be 2 inches by 1½ inches. The photographs must be printed on normal thin photographic paper and must not be glazed on the reverse side. The witness is also required to endorse the reverse side of one copy of the photograph with the words "I certify that this is a true likeness of the applicant Mr (Mrs or Miss) ..." and add his signature.
Where a joint passport is applied for one copy of the spouse's photograph should be similarly certified.
4. Documents to be produced
(a) If the applicant was born in Tuvalu —
applicant's birth certificate (or previous passport);
(b) If the applicant was born of a Tuvaluan father outside Tuvalu —
(i) applicant's birth certificate and his parent's marriage certificate;
(ii) his father's birth, naturalization or registration certificate or other evidence of Tuvalu citizenship
(c) If applicant is Tuvaluan by naturalization or by registration as a citizen of Tuvalu or of the United Kingdom and Colonies —
applicant's naturalization or registration document;
(d) If applicant acquired Tuvalu citizenship by marriage —
applicant's marriage certificate and documents establishing husband's (or former husband's) nationality as at (a), (b) or (c) above.
(e) A change of name other than by marriage must be substantiated by the production of evidence showing that a bona fide change has been made for all purposes.

APPLICATION FOR A PASSPORT AS A TUVALU CITIZEN FOR A CHILD UNDER 18 YEARS OF AGE9
To be completed by or with the written consent of the legal guardian of the child NOTES
HOW TO COMPLETE FORM
1. Sections 1, 2, 5 and 6 of this form must be completed on behalf of all children. Section 4 must also be completed on your own behalf. The form should be clearly written in ink using block capitals for all names.
2. Authentication of Application. The application must be witnessed in Section 5 by a Member of Parliament, Minister of Religion, public officer holding a post graded level 5 or above, an Island President, a person authorised to administer oaths or a person of similar standing to whom the applicant is personally known.
3. Photographs. Two copies of a recent photograph of the child must be included with the application. These photographs must be taken full face without hat, and the photographs must not be mounted. The size of the photographs must be approximately 2 inches by 1½ inches.
The photographs must be printed on normal thin photographic paper and must not be glazed on the reverse side. The witness is also required to endorse the reverse side of one copy of the photograph with the words "I certify that this is a true likeness of........................." and add his signature.
4. Documents to be produced
(a) If the child was born in Tuvalu —
child's birth certificate (or previous passport);
(b) If the child was born of a Tuvaluan father outside Tuvalu —
(i) child's birth certificate and his parents' marriage certificate;
(ii) father's birth, naturalisation or registration certificates, or other evidence of Tuvalu citizenship;
(c) If the child is Tuvaluan by naturalisation or by registration as a citizen of Tuvalu or of the United Kingdom and Colonies —
naturalisation or registration document;
(d) Children under 18 years of age may not be granted passport facilities without the written consent of the legal guardian, i.e. the father or, if the father is dead, the mother.
N.B.- The mother or any other person claiming, during the lifetime of the father, to be the legal guardian must either produce or state the precise terms of the court order committing the child to her or that person's custody.
(c) A change of name must be substantiated by the production of evidence showing that a bona fide change has been made.
