DIPLOMATIC PASSPORTS REGULATIONS[1]


1 Citation


These Regulations may be cited as the Diplomatic Passports Regulations.


2 Persons who may hold Diplomatic Passports


The persons or classes of persons set out in the Schedule of these Regulations shall, subject to the provisions of the Passports Act and to the making of an appropriate order in respect of each Diplomatic Passport under section 5(1) of the Passports Act, be the persons or classes of persons entitled to hold a Diplomatic Passport.


3 Conditions and limitations on use of Passport


(1) No person with the exception of the Governor General of Tuvalu and a citizen holding diplomatic status in a regional organization of which Tuvalu is a member shall be entitled to use a Diplomatic Passport which he holds except when travelling, working or living abroad on Government business or affairs and when in connection with such business or affairs that person is representing the Government of Tuvalu.


(2) All holders of Tuvalu Diplomatic Passports with the exception of the Governor General, the Prime Minister and a citizen holding diplomatic status in a regional organization of which Tuvalu is a member must deposit their Diplomatic Passports with the Secretary to Government at all times except when they need to hold the same for use in accordance with paragraph (1) of this Regulation.


(3) The Secretary to Government may decline to release a Diplomatic Passport to any holder if in his opinion the holder is not entitled to receive it in connection with use in accordance with paragraph (1) of these Regulations but if any holder is dissatisfied with the decision of the Secretary to Government then he may raise or ask the appropriate Minister to raise the question before Cabinet whose decision in this respect shall be final and binding on the Secretary to Government.


4 Surrender of Passports


Where any holder ceases to be one of the persons set out in the Schedule to these Regulations then he shall deliver his Diplomatic Passport to the Passport Officer as soon as is reasonably practicable and in any event within 14 days of the date when he ceased to be entitled to hold the same.


5 Penalty


Any person who contravenes or fails to comply with any of these Regulations is guilty of an offence and is liable to a fine of $100 or to a term of imprisonment not exceeding three months or both.

11. Citizens holding diplomatic status in a regional organization of which Tuvalu is a member

12. The Director of Economic Resource and Policy Division[2]

13. Members of Parliament and their spouses[3]

14. Deputy of Head of Regional Organization that Tuvalu is a member[4]

15. Heads of Government Departments[5]
