TRANSFER OF POWERS RULES

There are references to the Administrator in about 20 pieces of legislation that are Tokelau law. Most of these references are in regulations and are there within the power of the General Fono to change. The other references are in the Act of the New Zealand Parliament. Some of those, such as the power of disallowance, are not covered by the delegation and are not within the power of the General Fono to change. There are others, such as those in relation to Tokelau land, which are covered by the delegation but which cannot be changed by the General Fono.

Most of the references to the Administrator in Tokelau regulations relate to day to day management matters and are to do with powers which were exercised by the Official Secretary by delegation before the delegation to the General Fono and the Council of Faipule. The Administrator has typically not exercised those powers, and is unlikely now to exercise them personally.

There are other powers which involve the executive government of Tokelau (such as the Commissions of Inquiry Regulations) which the Administrator may wish to retain in the name of the Administrator—for instance, the powers under the Tokelau (EEZ) Fishing Regulations.

It is recommended that the powers of the Administrator that are not usually exercised by the Administrator personally and which are unlikely to be exercised by the Administrator personally be altered to the powers of the Council of Faipule.

(i) The references to the Administrator in the Tokelau Marriage Regulations, the Tokelau Adoption Regulations, the Tokelau Animals Regulations, the Tokelau Births and Deaths Registration Regulations, the Tokelau Business Restriction Regulations, the Tokelau Census Regulations, the Tokelau Customs Regulations, the Tokelau Divorce Regulations, the Tokelau Immigration Regulations, the Tokelau Plant Regulations, and the Tokelau Post Office Regulations should be repealed and replaced by references to the Council of Faipule.

(ii) In the Tokelau Rhinoceros Beetle Regulations 1964, reg 3 the definitions of "Administrator" and "Faipule" should be deleted, and in the definition of "Inspector" the reference to the Administrator should be repealed and replaced by a reference to the Taupulega.

(iii) Regulation 8 of the Tokelau Post Office Regulations should be repealed. (The power to operate telecommunication services in Tokelau is now exercised by Teletok.)

TRANSFER OF POWERS RULES

1 Regulations amended

(1) All references to the Administrator of Tokelau in the following regulations are repealed and replaced by references to the Council of Faipule:

(i) Tokelau Adoption Regulations;

(ii) Tokelau Animals Regulations;

(iii) Tokelau Births and Deaths Registration Regulations;

(iv) Tokelau Business Restriction Regulations;

(v) Tokelau Census Regulations;

(vi) Tokelau Customs Regulations;

(vii) Tokelau Divorce Regulations;

(viii) Tokelau Immigration Regulations;

(ix) Tokelau Marriage Regulations;

(x) Tokelau Plant Regulations;

(xi) Tokelau Post Office Regulations.

2 Tokelau Rhinoceros Beetle Regulations amended

The Tokelau Rhinoceros Beetle Regulations 1964 are amended:

(i) in regulation 3, by the deletion of the definitions of "Administrator" and "Faipule";

(ii) in the definition of "Inspector" in regulation 3, by the repeal of the reference to the Administrator and the substitution of a reference to the Taupulega.

3 Tokelau Post Office Regulations amended

The Tokelau Post Office Regulations are amended by the repeal of regulation 8.
