ARRANGEMENT OF SECTION.
Number of Judges (Amendment of Section 2).
AN ACT
entitled
National Court (Number of Judges) (Amendment) Act 2023,
Being an Act to amend the National Court (Number of Judges) Act 1984,
MADE by the National Parliament.
NUMBER OF JUDGES (AMENDMENT OF SECTION 2).
The Principal Act is amended by repealing Section 2 and replacing it with the following new section:
"2. NUMBER OF JUDGES.
(1) The number of Judges of the National Court shall not be less than sixty and not more than two hundred, as is determined by the Head of State, acting with the advice of the National Executive Council given after considering a report from the Chief Justice.
(2) The Chief Justice shall, in his report to the National Executive Council under Subsection (1) and Subsection (3), include the following factors:
- (a) vacancy in positions and the need or demand for appointments to be made; and
- (b) the annual budget appropriation being available at the relevant time.
(3) Following the appointment of the first sixty Judges, a determination of the number of judges from sixty-one up shall be made by the National Executive Council after considering a report from the Chief Justice.".
