"4C. ACT NOT TO APPLY TO P'NYANG LNG PROJECT.".

AN ACT

entitled

Konebada Petroleum Park (P'nyang LNG Project) (Amendment) Act 2022,

Being an Act to amend the Konebada Petroleum Park Act 2008 and for related purposes,

MADE by National Parliament.

1. INTEPRETATION (AMENDMENT OF SECTION 3).

Section 3 of the Principal Act is amended in Subsection (1) by -

(a) inserting immediately after the definition "principal customs area" the following new definitions in alphabetical order:

• "P'nyang LNG Project" has the meaning given to Project in the P'nyang LNG Project Gas Agreement;
• "P'nyang LNG Project Area" has the meaning given to Project Area in the P'nyang LNG Project Gas Agreement;
• "P'nyang LNG Project Assets" has the meaning given to Project Assets in the P'nyang LNG Project Gas Agreement;
• "P'nyang LNG Project Contractor" has the meaning given to Project Contractor in the P'nyang LNG Project Gas Agreement;
• "P'nyang LNG Project Entity" has the meaning given to Project Entity in the P'nyang LNG Project Gas Agreement;
• "P'nyang LNG Project Gas Agreement" means the P'nyang LNG Project Gas Agreement dated on or about 22 February 2022 between the Independent State of Papua New Guinea, Esso PNG P'nyang Limited, Ampolex (Papua New Guinea) Limited, Oil Search Limited, Oil Search (PNG) Limited and Merlin Petroleum Company, as amended, novated or replaced from time to time;
• "P'nyang LNG Project Operations" has the meaning given to Project Operations in the P'nyang LNG Project Gas Agreement;
• "P'nyang LNG Project Petroleum" has the meaning given to Project Petroleum in the P'nyang LNG Project Gas Agreement;"; and

(b) repealing the definition "Park" and replacing it with the following new definition:

• "Park" means the area of land in Central Province and the National Capital District together with any adjacent offshore area to be known as the Konebada Petroleum Park as defined in Section 3(4), excluding the area of any such land that is within -
  • (a) the LNG Project Area; or
  • (b) the Papua LNG Project Area; or
  • (c) the P'nyang LNG Project Area;" and

(c) repealing Subsection (4) and replacing it with the following new subsection:

• "(4) The area of the Park shall be as defined by notice published by the Minister responsible for Lands and Physical Planning matters in the National Gazette from time to time, but such a notice may not include in that area the area of any land that is within -
  • (a) the LNG Project Area; and
  • (b) the Papua LNG Project Area; and
  • (c) or the P'nyang LNG Project Area,

and to the extent that any land included in the area set out in the notice is within the LNG Project Area or the Papua LNG Project Area or the P'nyang LNG Project Area, the notice will by force of Subsection (4) be deemed to be void and of no force or effect.".

2. NEW SECTION 4C.

The Principal Act is amended in Section 4 by inserting immediately after Section 4B the following new Section:

"4C. ACT NOT TO APPLY TO P'NYANG LNG PROJECT.
Notwithstanding any other provision of this Act or any other Act, nothing in this Act applies, and the powers and functions of the Authority do not extend to or in respect of -

• (a) any part of the P'nyang LNG Project; or
• (b) any part of the P'nyang LNG Project Area; or
• (c) any P'nyang LNG Project Assets; or
• (d) any P'nyang LNG Project Entity or P'nyang LNG Project Contractor undertaking any P'nyang LNG Project Operations; or
• (e) any P'nyang LNG Project Operations; or
• (f) any P'nyang LNG Project Petroleum or any petroleum products manufactured or derived from any P'nyang LNG Project Petroleum, including as such P'nyang LNG Project Petroleum or petroleum products may be used (as feedstock or otherwise) or processed in any P'nyang LNG Project Operations.".
