“4B. ACT NOT TO APPLY TO PAPUA LNG PROJECT.”.

AN ACT

entitled

Konebada Petroleum Park Authority (Papua LNG Project)(Amendment) Act 2019,

Being an Act to amend the Konebada Petroleum Park Authority Act 2008,

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

1 INTERPRETATION (AMENDMENT OF SECTION 3).

(1) Section 3(1) of the Principal Act is amended by inserting the following new definitions:

“Papua LNG Project” has the meaning given to Project in the Papua LNG Project Gas Agreement;
“Papua LNG Project Area” has the meaning given to Project Area in the Papua LNG Project Gas Agreement;
“Papua LNG Project Assets” has the meaning given to Project Assets in the Papua LNG Project Gas Agreement;
“Papua LNG Project Contractor” has the meaning given to Project Contractor in the Papua LNG Project Gas Agreement;
“Papua LNG Project Entity” has the meaning given to Project Entity in the Papua LNG Project Gas Agreement;
““Papua LNG Project Gas Agreement” means the Papua LNG Project Gas Agreement dated 9 April 2019, between the Independent State of Papua New Guinea, Total E & P PNG Limited, ExxonMobil PNG Antelope Limited, ExxonMobil PNG Elk Limited, PAC LNG Assets Limited, PAC LNG International Limited, PAC LNG Investments Limited, PAC LNG Overseas Limited and PAC LNG Holdings Limited, as amended, novated or replaced from time to time;
“Papua LNG Project Operations” has the meaning given to Project Operations in the Papua LNG Project Gas Agreement;
“Papua LNG Project Petroleum” has the meaning given to Project Petroleum in the Papua LNG Project Gas Agreement.”.

(2) Section 3(1) of the Principal Act is amended by repealing the definition of “Park” and replacing it with the following:

““Park” means the area of land in Central Province and the National Capital District together with any adjacent offshore area to be known as the Konebada Petroleum Park as defined in Section 3(4), excluding the area of any such land that is within -

• (a) the LNG Project Area; or
• (b) the Papua LNG Project Area.”.

(3) Section 3 of the Principal Act is amended by repealing Subsection (4) and replacing it with the following:

“(4) The area of the Park shall be as defined by notice published by the Minister responsible for Lands and Physical Planning matters in the National Gazette from time to time, but such a notice may not include in that area the area of any land that is within -

• (a) the LNG Project Area; or
• (b) the Papua LNG Project Area, and to the extent that any land included in the area set out in the notice is within the LNG Project Area or the Papua LNG Project Area, the notice will by force of this subsection be deemed to be void and of no force or effect.”.

2 NEW SECTION 4B.

The Principal Act is amended by inserting a new section after Section 4 as follows:

“4B. ACT NOT TO APPLY TO PAPUA LNG PROJECT.
Notwithstanding any other provision of this Act or any other Act, nothing in this Act applies, and the powers and functions of the Authority do not extend to or in respect of -

• (a) any part of the Papua LNG Project; or
• (b) any part of the Papua LNG Project Area; or
• (c) any Papua LNG Project Assets; or
• (d) any Papua LNG Project Entity or Papua LNG Project Contractor undertaking any Papua LNG Project Operations; or
• (e) any Papua LNG Project Operations; or
• (f) any Papua LNG Project Petroleum or any petroleum products manufactured or derived from any Papua LNG Project Petroleum, including as such Papua LNG Project Petroleum or petroleum products which may be used (as feedstock or otherwise) or processed in any Papua LNG Project Operations.”.
