ARRANGEMENT OF SECTIONS.

1. Treason (Amendment of Section 37).
2. Punishment of piracy (Amendment of Section 81).
3. Attempted piracy with personal violence (Amendment of Section 82).
4. Wilful murder (Amendment of Section 299).
5. Wilful murder of a person on account of accusation of sorcery (Amendment of Section 299A).
6. Aggravated rape (Amendment of Section 347C).
7. The offence of robbery (Amendment of Section 386).

AN ACT

entitled

Criminal Code (Amendment) Act 2022.

Being an Act to amend the Criminal Code Act (Chapter 262) provisions relating to death penalty and for related purposes,

MADE by the National Parliament.

1. TREASON (AMENDMENT OF SECTION 37).

Section 37 of the Principal Act is amended by repealing the penalty provision and replacing it with the following:

"Penalty: Life imprisonment without parole.".

2. PUNISHMENT OF PIRACY (AMENDMENT OF SECTION 81).

Section 81 of the Principal Act is amended in Subsection (2), by repealing the words and the full stop "the offender is liable to the punishment of death." and replacing them with the following:

"the offender is liable to be sentenced to life imprisonment and is eligible for parole after 30 years.".

3. ATTEMPTED PIRACY WITH PERSONAL VIOLENCE (AMENDMENT OF SECTION 82).

Section 82 of the Principal Act is amended by repealing the penalty provision and replacing it with the following:

"Penalty: Life imprisonment and eligible for parole after 30 years.".

4. WILFUL MURDER (AMENDMENT OF SECTION 299).

Section 299 of the Principal Act is amended in Subsection (2), by repealing the words and the full stop "shall be liable to be sentenced to death." and replacing them with the following:

"shall be liable to be sentenced to life imprisonment without parole.".

5. WILFUL MURDER OF A PERSON ON ACCOUNT OF ACCUSATION OF SORCERY (AMENDMENT OF SECTION 299A).

Section 299(A) of the Principal Act is amended in Subsection (1), by repealing the words and the full stop "shall be sentenced to death." and replacing them with the following:

"shall be sentenced to life imprisonment and is eligible for parole after 30 years.".

6. AGGRAVATED RAPE (AMENDMENT OF SECTION 347C).

Section 347C of the Principal Act is amended by repealing the words and the full stop of the penalty provision, "shall be sentenced to death." and replacing them with the following:

"is liable to life imprisonment without parole.".

7. THE OFFENCE OF ROBBERY (AMENDMENT OF SECTION 386).

Section 386 of the Principal Act is amended in Subsection (2) by repealing the words and the full stop "is liable to be sentenced to death." and replacing them with the following:

"is liable to be sentenced to life imprisonment and is eligible for parole after 30 years.".
