AN ACT

entitled

Building (Amendment) Act 2022.

Being an Act to amend the Building Act 1971 and for related purposes,

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting on the advice of the Minister.

1. INTERPRETATION (AMENDMENT OF SECTION 1).

Section 1 of the Principal Act is amended by inserting the following new definitions in their correct alphabetical order:

""Class A unit" means a unit classified as a class A unit in a strata plan under the Strata Title Act 2022;
"Class B unit" means a unit classified as a class B unit in a strata plan under the Strata Title Act 2022;
"staged development", in relation to a strata title application, means a strata development that takes place in stages where each stages require separate approval;".

2. APPLICATION TO BUILDINGS (AMENDMENT OF SECTION 4).

Section 4 of the principal Act is amended -

(a) by inserting "(1)" in front of the words "This Act Applies"; and

(b) by inserting immediately after Subsection (1) the following new sections:

• "(2) All buildings in a strata development lease issued under the Land Act 1996 are subject to the Strata Title Act 2022.
• (3) Where there is an inconsistency between this Act and the Strata Title Act 2022, the Strata Title Act 2022 prevails.".
