ARRANGEMENT OF SECTIONS.
Telecommunication (Cable Television Service Licence Fees) Regulation 2005
MADE by Head of State, acting with, and in accordance with, the advice of the National Executive Council under the Telecommunications Act 1996, to be deemed to have come into operation on 1 January 2005.
In this Regulation, unless the contrary intention appears –
“Annual Subscription Fee” means the monthly fee charged for subscribing to a service, averaged over the period of three months immediately prior to commencement of the licensing year, multiplied by 12;
“Commission” means the Independent Consumer Competition Commission;
“licensing year” means the 12 months from the date of issue of a new licence, or renewal of licence;
“Number of Customers” means the persons who have subscribed each month to a service, averaged over the period of three months immediately prior to the commencement of the licensing year;
“the Act” means the Telecommunications Act 1996.
The fee for an application under Section 117 of the Act for cable television service licence is K100.00.
(1) The annual licence fee, required under Section 118 of the Act, for each cable television shall be an amount equal to one-twentieth of the Annual Subscription Fee multiplied by the Number of Customers, multiplied by 12 months.
(2) For the purposes of Subsection (1), where a licence is being sought for a service which is not already being provided, the Annual Subscription Fee shall be calculated on the basis of the subscription fee which the licensee proposes to charge, the Number of Customers shall be based on the anticipated number of subscribers each month, averaged over the first 12 months.
All fees shall be payable to the Commission in advance at the commencement of the licensing year, or by agreement between the licensee and the Commission, in advance in four equal quarterly instalments during the licensing year.
