AN ACT

to amend the Arms Act 1975

1 Short title

(1) This Act may be cited as the Arms (Amendment) Act 1998.

2 Arms Act 1975 amended

The Arms Act 1975 is amended by inserting after section 13 the following section-

"13A Offence to discharge firearm near residence

(1) A person must not discharge a firearm within 100 metres of a building being used as a residence.

(2) A person who fails to comply with subsection (1) is guilty of an offence and is liable on conviction to a fine not exceeding $500 or for a second or subsequent offence to a fine not exceeding $1000 or imprisonment for a term not exceeding 6 months or both such fine and imprisonment.

(3) Subsection (1) does not apply to a police officer in the execution of his or her duties."

The Niue Assembly passed this Act on the 3rd day of June 1998.
