Enacted by the Parliament of Nauru as follows:

1. Short title

This Act may be cited as the Supreme Court (Amendment) Act 2019.

2. Commencement

This Act commences upon certification by the Speaker.

3. Amendment of the Supreme Court Act 2018

The Supreme Court Act 2018 is amended by the provisions of this Act.

4. Amendment of section 38

Section 38(2) is deleted and substituted as follows:

‘(2) Where the District Court has acquitted an accused person in any criminal cause or matter:

(a) the Director of Public Prosecutions; or

(b) with his or her sanction in writing, the person who prosecuted the criminal cause or matter before the District Court, -

may appeal the judgment, decision or order of acquittal to the Supreme Court.’
