NAURU POLICE FORCE (AMENDMENT) ACT 2021

An Act to amend the Nauru Police Force Act 1972.

Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Nauru Police Force (Amendment) Act 2021.

2 Commencement

This Act commences on certification by the Speaker.

3 Amendment of the Nauru Police Force Act 1972

The Nauru Police Force Act 1972 is amended by the provisions of this Act.

4 Amendment of Section 2

Section 2 is amended by inserting the following term and its definition in alphabetical order:

‘Deputy Commissioner’ means the Deputy Commissioner of Police appointed under the provisions of Section 6;

5 Amendment of Section 3

Subsection (2) is amended by:

(a) deleting the words ‘of Police’ where they appear immediately after the word ‘Commissioner’; and

(b) inserting the words ‘Deputy Commissioner,’ immediately after the word ‘Commissioner of Police’ where it appears.

The subclause now reads:

‘(2) The force shall consist of the Commissioner, Deputy Commissioner, Superintendent of Police, Inspectors and Officers of such other ranks as the Minister may from time to time by notice in the Gazette direct.’

6 Amendment of Section 6

Section 6(2) is deleted and substituted as follows:

‘(2) The Commissioner shall appoint from among serving officers of the force:

(a) a Deputy Commissioner, with the consent of the Minister and Police Service Board;

(b) the Superintendent of Police, with the consent of the Minister; and

(c) Inspectors, with the consent of the Police Service Board.’

7 Amendment of Section 8

Subsection (2)(a) is amended by inserting the words ‘Deputy Commissioner,’ immediately after the words ‘Commissioner’.

8 Amendment of Section 36

Section 36 is amended as follows:

(a) in subsection (1), by deleting the words ‘Any Superintendent of Police, Inspector, non-commissioned officer, Constable or Reserve Officer’ where they appear and substituting with the words ‘A police officer’; and

(b) in subsection (2), by inserting the words ‘Deputy Commissioner,’ immediately before the words ‘Superintendent of Police’.

9 Amendment of Section 53

Section 53 is amended by inserting the words ‘Deputy Commissioner,’ immediately before the words ‘Superintendent of Police’.
