Nauru Police Force (Amendment) Act 1987

REPUBLIC OF NAURU

A BILL FOR AN ACT

To amend the Nauru Police Force Act, 1972

Enacted by the Parliament of Nauru as follows:

SHORT TITLE AND CITATION

1. (1) This Act may be cited as the Nauru Police Force (Amendment) Act 1987.

(2) The Nauru Police Force Act 1972 is in this Act referred to as "the Principal Act".

(3) The Principal Act as amended by this Act may be cited as the Nauru Police Force Act 1972-1987.

AMENDMENT TO SECTION 2 OF THE PRINCIPAL ACT

2. Section 2 of the Principal Act is amended by adding thereto the following new definition at the end:-

"Superintendent of Police" means the Superintendent of Police appointed under the provisions of Section 6 of this Act.

AMENDMENT TO SECTION 3 OF THE PRINCIPAL ACT

3. Section 3 of the Principal Act is amended by deleting from sub-section (2) thereof the words
"Director of Police, inspectors and officers of such other ranks" and by inserting in lieu thereof the words "Director of Police, Superintendent of Police, Inspectors and Officers of such other ranks".

AMENDMENT TO SECTION 6 OF THE PRINCIPAL ACT

4. Section 6 of the Principal Act is amended

(a) by deleting the words "Inspectors" from subsection (2) thereof and inserting in lieu thereof the words "The Superintendent of Police and Inspectors";

(b) by deleting full stop at the end thereof and by inserting in its place a colon; and

(c) by the addition of the following new proviso thereto:-

"Provided further that the Director of Police shall not appoint any person to be the Superintendent of Police unless he has obtained the consent of the Minister to his appointment."

AMENDMENT TO SECTION 8 OF THE PRINCIPAL ACT

5. Section 8 of the Principal Act is amended by the deletion of the words "Director, inspector or non-commissioned officer" in clause (a) of sub-section (2) thereof and inserting the words "Director, Superintendent of Police, Inspector or non-commissioned officer".

AMENDMENT TO SECTION 36 OF THE PRINCIPAL ACT

6. Section 36 of the Principal Act is amended -

(a) by deleting the words "Any inspector, non-commissioned officer, constable or reserve officer" from sub-section (1) thereof and inserting in lieu thereof the words "Any Superintendent of Police, Inspector, non-commissioned officer, Constable or Reserve Officer";

(b) by deleting the words "any inspector, non-commissioned officer or constable" from the opening paragraph of sub-section (2) thereof and inserting in lieu thereof the words "the Superintendent of Police, an inspector, non-commissioned officer or Constable";

(c) by deleting the words "an inspector or a non-commissioned officer" from clause (a) sub-section (2) thereof and by inserting in lieu thereof the words "the Superintendent of Police, an Inspector or a non-commissioned officer";

(d) by deleting the words "an inspector or a non-commissioned officer" from clause (b) of sub-section (2) thereof and by inserting in lieu thereof the words "the Superintendent of Police, an Inspector or a non-commissioned officer".

AMENDMENT TO SECTION 53 OF THE PRINCIPAL ACT

7. Section 53 of the Principal Act is amended by deletion of the words "any inspector" and by inserting in lieu thereof the words "the Superintendent of Police or any Inspector".
