SALARIES AND ALLOWANCES OF MEMBERS OF THE MANEABA NI MAUNGATABU ACT 1980

AN ACT TO MAKE PROVISION FOR THE SALARIES,
ALLOWANCES AND OTHER FINANCIAL PRIVILEGES OF
THE MEMBERS OF THE MANEABA NI MAUNGATABU.

Commencement: 1 August,
1979.

MADE by the Maneaba ni Maungatabu and assented by the Beretitenti.

Short title.

1. This Act may be cited as the Salaries and Allowances of Members of the Maneaba ni Maungatabu Act, 1980, and shall be deemed to have come into operation on 1 August 1979.

Interpretation.

2. In this Act "Member" includes the Beretitenti and Ministers unless the contrary intention appears.

Salaries and entertainment allowances

3. The holder of the office specified in the first column of the Schedule shall be paid an annual salary of the amount shown in the second column of the Schedule and an annual entertainment allowance of the amount shown in the third column.

Travelling allowances and privileges

4. (1) When on official visits overseas, the Beretitenti and Ministers shall be entitled to first class air travel; other Members shall be entitled to economy class air travel.

(2) All Members whilst in Tarawa for business they have been invited to attend, including seminars, committees, and other business in addition to meetings of the Maneaba ni Maungatabu, shall be entitled to free launch and bus tickets within South Tarawa commencing from the arrival of the Member until the completion of the business.

(3) Whilst travelling on official business on vessels of the Kiribati Shipping Corporation, all Members (and their wives if accompanying them) shall be entitled to free first class passages.

(4) The Beretitenti and Ministers shall be entitled to free sea or air passages when travelling within Kiribati on official business, and twice each year shall be entitled to free passages for their wives accompanying them. Where a wife accompanies her husband on more than two occasions she shall be entitled to subsidized passages on the same terms as the wife of a public officer accompanying her husband on official business.

(5) When any other Member travels to South Tarawa on official business he shall be entitled to free sea or air passages, and twice each year he shall be entitled to free passages for his wife when accompanying him. Where a wife accompanies her husband on more than two occasions in a year, she shall be entitled to subsidized passages on the sane terms as the wife of a public officer accompanying her husband on official business.

Car allowance etc.

5. (1) The Beretitenti shall be entitled to be provided with a free motor car and motor launch, fuelled, staffed and serviced at Government expense.

(2) A Minister who owns a motor car and uses it on official business shall be entitled to a yearly allowance of $480.

Subsistence allowances.

6. (1) A Member when on official business overseas shall be paid subsistence allowances on the same basis as a public officer.

(2) The Beretitenti when on official business overseas shall be paid an allowance of $15 per day and other Members an allowance of $10 per day in addition to the subsistence allowance payable under subsection (1).

(3) A Member absent from his island of residence on official business shall be paid subsistence allowances on the same basis as a public officer.

Residence of Beretitenti.

7. (1) The Beretitenti shall be entitled to reside at the State House rent-free and without charge for electricity. The State House shall be made available cleaned, maintained and staffed as provided for by the Annual Estimates, without charge to the Beretitenti.

(2) The Kauoman ni Beretitenti, whilst acting as Beretitenti may reside at the State House on the same terms as the Beretitenti.

Advances of salary.

8. A Member shall be entitled to an advance of salary on the same basis as a public officer.

Clothing allowance.

9. A Member travelling overseas on official business shall be entitled to be paid a clothing allowance on the same basis as a public officer attending a course of training overseas.

Letters and telegrams.

10. Members shall be entitled to send letters and telegrams through official channels free of charge when the letters and telegrams are sent on official business to Island Councils, government departments, government owned companies and statutory bodies.

Allowances free from income tax.

11. All allowances provided for by this Act shall be paid free from of income tax.

SALARIES AND ALLOWANCES OF MEMBERS OF THE MANEABA NI MAUNGATABU ACT, 1980

EXPLANATORY MEMORANDUM

Section 65 of the Constitution provides for the salaries and allowances of Member of the Maneaba ni Maungatabu to be reviewed by an independent tribunal, and for the tribunal to make recommendations as to salaries and allowances to the Maneaba. The Constitution does not, however, provide for how the salaries and allowances are to be approved. It is considered appropriate that such provision be made by an Act, similar to the Statutory Salaries Ordinance, which deals with the salaries of certain senior public officers.

The Act takes into account, but does not follow completely, the recommendations so far submitted to Maneaba by the tribunal.

The Act is to operate retrospectively from 1 August, 1979.
