AN ACT TO AMEND THE PUBLIC HOLIDAYS ORDINANCE.

1. Short title
This Act may be cited as the Public Holidays (Amendment) Act 2005.
2. New section 9
The Public Holidays Ordinance (Cap.81) is amended after section 8 by inserting the following section -
"9. Amendment of Schedule
The Minister, acting in accordance with the advice of the Cabinet, may from time to time, by notice published in the Gazette, -
(a) amend the Schedule; or
(b) repeal the Schedule and substitute a new Schedule."
THE PUBLIC HOLIDAYS (AMENDMENT) ACT 2005
EXPLANATORY MEMORANDUM
This short Act seeks to remedy problems that have been experienced in recent years with the fixing of public holidays. At present
the Schedule of public holidays can only be changed through passage of amending legislation. This has led to an undesirable lack
of flexibility.
Under the proposed section 9, the Minister, acting in accordance with the advice of the Cabinet, will have power to amend the Schedule
simply by publishing a notice to that effect in the Gazette. The Minister will retain the power under section 6 to vary the days
fixed as public holidays on an ad hoc basis. It is envisaged that section 9 will be used to fix public holidays on a general basis,
with section 6 being used to make any variations as may be necessary from year to year.
