PENAL CODE AMENDMENT ACT 1984
(NO. 10 OF 1984)
AN ACT TO AMEND THE PENAL CODE (Cap 67)
Commencement: 10 December 1984.
MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.
Short title
1. This Act may be cited as the Penal Code (Amendment) Act 1984.
Amendment of section 46 of the Penal Code (Cap 67)
2. Section 46 of the Penal Code (Cap 67) is amended by-
(a) repealing in subsection (1) the words "days (being in the aggregate not less than 40 nor more than 150)", and substituting the following:
"days being in the aggregate not more than 300".
(b) adding after subsection (6) the following subsection:
"(7) A copy of any order made under subsection (1) hereof shall be sent to the Superintendent of Prisons and to the public officer concerned with supervising the community service of the convicted person".

PENAL CODE (AMENDMENT) ACT 1984
EXPLANATORY MEMORANDUM
The Act amends Section 46 of the Penal Code (Cap 67) which deals with the power of the courts to impose community service orders instead of sentencing convicted persons to terms
of imprisonment. Section 46 as it now stands provides that community service shall be for not less than 40 nor more than 150 days.
This Act seeks to give the courts the power to impose any sentence of up to 300 days. Provision is further made for the notification of community service orders to the Superintendent of Prisons and the officer charged with supervising the
order.
