AN ACT TO AMEND THE PASSPORT ACT (REVISED EDITION 1996)
Commencement:
2004
MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti.
Short title
1. This Act may be cited as the Passport (Amendment) Act 2004.
Amendment of section 3
2. Section 3 of the Passport Act (Revised Edition 1996) (hereinafter called the principal Act) is amended by repealing the following
definitions -
(a) “foreign investor” and
(b) “investor passport”.
Amendment of section 4
3. Section 4 of the principal Act is amended -
(a) in subsection (1) -
(i) by repealing the whole subsection and substituting the following -
“4. (1) The Passport Officer shall, upon application made to him in the appropriate form, issue to any citizen of Kiribati who satisfies such condition as may be prescribed, a passport in an approved form.”
(ii) by repealing paragraph (b); and
(b) in subsection (2), by repealing paragraph (c).
Amendment of section 4A
4. Section 4A of the principal Act is repealed.
Amendment of section 4B
5. Section 4B of the principal Act is repealed.
Amendment of section 5
6. Section 5 of the principal Act is amended by repealing the words “referred to in section 4(1)”.
Amendment of section 9
7. Section 9 of the principal Act is amended as follows -
(a) in subsection (l) -
(i) by repealing the words “subject to the approval of the Minister in writing” between the words “may” and “issue” in the second line;
(ii) by repealing the words “to citizens of Kiribati or aliens” between the words “document” and “which” in the third line; and
(b) by repealing subsection (3).

EXPLANATORY MEMORANDUM
This short Act repeals provisions in the Passports Act relating to what has been known over the years as the foreign investor scheme. The amendments to the said Act that were enacted in
1996 to put the scheme in place are now being repealed.
